Twenty Twenty Floor Competition Terms & Conditions
The Godfreys “Twenty-Twenty Floor” Competition (“Competition”) is conducted by Electrical Home-Aids Pty Limited ABN 62 007 539 577 of Brandon Office Park, Building 3, First Floor 530-540 Springvale Road, Glen Waverley VIC 3150 (“Godfreys”). These terms apply to the conduct of the Competition. By entering the Competition, you agree to be bound by these terms and any other terms attached to the prize (including the terms of redemption).
Key Dates and Locations
The Competition commences at 10:00am NZDT on 1st January 2024 and ends at 11:59pm NZDT on 8th January 2024 (“Competition Period”).
The Competition will be drawn with one (1) winner at 11:00am AEDT on 10th January 2024 at Brandon Office Park, Building 3, First Floor 530-540 Springvale Road, Glen Waverley, VIC, 3150, Australia (“Draw Date”).
Eligibility
The Competition is open to any New Zealand resident over the age of 18 (“Eligible Participant”).
A director or employee of Godfreys or any entity associated with the conduct of this Competition or an immediate family member of an employee of Godfreys or any other entity associated with the conduct of this Competition will not be an Eligible Participant. Immediate family member includes, but is not limited to, spouse, ex-spouse, de-facto spouse, child or step-child, parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or immediate first cousin.
Entry into Competition
This Competition is a game of chance. To enter the Competition, you must:
1. be an Eligible Participant;
2. be following the @godfreysvacuumsnz Instagram account; and
3. tag two unique friends (in the same comment) on our Competition post
An Eligible Participant receives one (1) entry into the Competition for every comment made that tags two other unique accounts (“Entry”). There is no limit on the number of entries that can be made by a single Eligible Participant. If more than two accounts are tagged in a single comment it will not grant additional entries. If there is one or no account tagged, this will not be deemed as an Entry.
An Eligible Participant will be entered into the Competition upon the receipt of their eligible comment(s) on the Instagram post.
Validity of Entries
Godfreys reserves the right to verify the validity of Eligible Participants (including their identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any Eligible Participant who Godfreys has reason to believe has breached any of these terms, tampered with the entry process or engaged in any unlawful or other improper misconduct which may jeopardise the fair and proper conduct of the Competition. Errors and omissions may be accepted and rectified at Godfreys’ discretion. Failure by Godfreys to enforce any of its rights at any stage does not constitute a waiver of those rights. Godfreys’ legal rights to recover damages or other compensation from such a participant are reserved.
Draw
All Entries from Eligible Participants will be placed into the draw. Godfreys will draw the Competition on the Draw Date to decide the one (1) Eligible Participant’s Entry that is deemed the winning entry (“Winner”)
The Winner will be notified on Instagram within five (5) business days of the Draw Date.
On the Draw Date, Godfreys will also draw one (1) additional reserve entry following the Competition draw (“Reserve Draw”). The Eligible Participant that is drawn in the Reserve Draw is a reserve winner (“Reserve Winner”). The Reserve Winner will replace a Winner in the event that it is determined by Godfreys in its sole discretion that a Winner is not an Eligible Participant or in the event that the Winner does not claim the prize within 90 days of being notified of their entitlement to the prize.
Prize
The total value of the prize pool is RRP $699 NZD. A total of one (1) prize is available. The prize is a Bissell Crosswave® HydroSteam™ Hard Floor Cleaner valued at $699 NZD (RRP) (“Prize”).
Godfreys will contact the Winner via Instagram within five (5) business days of the competition winner being drawn to arrange the most effective method to provide the Winner with the Prize.
The Prize may not be transferred or exchanged.
In the event a Prize is not collected by a Winner within 90 days of that Winner being notified of their entitlement to a Prize, that Prize will be forfeited, and Godfreys will award the Prize to the Winner of the Reserve Draw (see below).
If the Prize (or any part thereof) is unavailable, Godfreys in its discretion, reserves the right to substitute the Prize (or that part thereof) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
Redraw for Unclaimed Prize
Where a Winner does not claim their Prize within 90 days of that Winner being notified of their entitlement to the Prize in accordance with these Terms and Conditions, this Winner will no longer be entitled to the Prize. In this case, the winner of the Reserve Draw will replace the winner. In the event that the Reserve Draw Winner does not claim the prize within 90 days of being notified of their entitlement to the prize, Godfreys will conduct an additional draw to determine a replacement of the Reserve Draw Winner (“Unclaimed Prize Draw”).
The first valid Entry from the Unclaimed Prize Draw will become a Winner and will be entitled to the Prize as if they were the Winner. In the event that this entrant also fails to claim the Prize within 90 days, this process will repeat until the Prize is claimed.
Godfreys’ decision is final and no correspondence will be entered into.
General
All Eligible Participants consent to: (a) participate in reasonable promotional activities, including but not limited to interviews and photographic and recording sessions, in respect to their participation in the Competition (including any outcome); and (b) Godfreys using their personal information including but not limited to their name, likeness, image and/or voice in the event they are a Winner (including photograph, film and/or recording) in any media for an unlimited period without remuneration for the purpose of promoting this Competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by Godfreys or their related entities, or for any other promotional matter at Godfreys' discretion.
If the Competition is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the control of Godfreys, including but not limited to technical difficulties, unauthorised intervention or fraud, or force majeure, Godfreys reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any Eligible Participants or Entries; or (b) to modify, suspend, terminate or cancel the Competition, as appropriate, at any time, subject to any applicable laws. Any such changes will be notified on the Godfreys website at https://www.godfreys.co.nz or in each participating Godfreys store.
Nothing in these terms limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Consumer Guarantees Act 1993, as well as any other consumer protection laws in New Zealand (“Non-Excludable Guarantees”). Except for any liability that cannot be excluded by law, including the Non-Excludable Guarantees, Godfreys (including its respective officers, employees and agents and related entities) excludes all liability (including negligence) and will not be liable for: (a) any personal injury; (b) any loss or damage (including loss of opportunity) including direct, indirect or consequential loss (c) third party interference; (d) late, lost, altered, damaged or misdirected Entries; (e) variation in the Prize; (f) any tax liability incurred by a Winner or Eligible Participants; (g) use of / taking of the Prize; or (h) technical malfunction impacting the operation of the Competition, arising in any way out of the Competition.
As a condition of accepting the Prize, a Winner must sign any legal documentation as and in the form required by Godfreys and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
Privacy Notice
By entering the Competition, each Buyer and Eligible Participant consents to the collection of their personal information by Godfreys. Personal information collected will be used to facilitate the administration of this Competition, marketing of the Competition and Godfreys, and to allow Godfreys to communicate with Buyers and Eligible Participants.
Godfreys may disclose personal information to third parties for the above listed purposes. Godfreys will collect and store personal information in accordance with the Privacy Act 2020 and the terms of its privacy policy, a copy of which can be accessed at https://www.godfreys.co.nz/privacy-policy. Each Winner consents to the publication of their name and suburb of residence as required by law.
