WIN a Hand Vacuum from Optim!

The Godfreys Hand Vacuum Instagram Giveaway (“Giveaway”) is conducted by Electrical Home-Aids Pty Limited ABN 62 007 539 577 of Brandon Office Park, Building 3, First Floor 530-540 Springvale Road, Glen Waverley VIC 3150 (“Godfreys”).  These terms apply to the conduct of the Giveaway.  By entering the Giveaway, you agree to be bound by these terms and any other terms attached to the prize (including the terms of redemption).  The Giveaway is conducted in New Zealand.

The Giveaway commences at 9am AEDT on 1 March 2022 and ends at 11:59pm AEDT on 31 March 2022 (“Giveaway Period”). 

The Giveaway will be drawn at 10am AEDT on 4 April 2022 at Brandon Office Park, Building 3, First Floor 530-540 Springvale Road, Glen Waverley VIC 3150 (“Draw Date”).

The Giveaway is open to any Godfreys customer who:

1.      is a New Zealand resident and over the age of 18; and

2.      elects to enter the Giveaway.

The Giveaway is open to any Godfreys customer who:

4.      elects to enter the Giveaway.

(“Eligible Participant”).

An employee of Godfreys or any entity associated with the conduct of this Giveaway or an immediate family member of an employee of Godfreys or any other entity associated with the conduct of this Giveaway will not be an Eligible Participant.  Immediate family member includes, but is not limited to, spouse, ex-spouse, de-facto spouse, child or step-child, parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or immediate first cousin.

This Giveaway is a game of chance.  There is no element of skill involved in the Giveaway.

To enter the Giveaway, you must:

1.      Have an Instagram account;

2.      Follow @godfreysvacuumsnz on Instagram;

3.      Save the post that announces the Giveaway (“Giveaway Post”); and

4.      Tag a friend in the comment section of the Giveaway Post.

If an Instagram user is an Eligible Participant, the Eligible Participant will be entered into the Giveaway upon completion satisfaction of all entry criteria set out above.

An Eligible Participant receives one (1) entry into the Giveaway for each comment made in the comment section of the Giveaway Post.  You may submit multiple entries provided each entry is unique, however each Eligible Participant is not eligible to win more than one (1) Prize even if the Eligible Participant has multiple Entries in the Giveaway.

There is no limit on the number of Eligible Participants that can participate in the Giveaway.

Godfreys reserves the right to verify the validity of Eligible Participants (including their identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any Eligible Participant who Godfreys has reason to believe has breached any of these terms, tampered with the entry process or engaged in any unlawful or other improper misconduct which may jeopardise the fair and proper conduct of the Giveaway.  Errors and omissions may be accepted and rectified at Godfreys’ discretion.  Failure by Godfreys to enforce any of its rights at any stage does not constitute a waiver of those rights.  Godfreys’ legal rights to recover damages or other compensation from such a participant are reserved.

Godfreys advises that this Giveaway is in no way sponsored, endorsed or associated with Instagram.

The total value of the prize pool is NZ$158.  A total of two (2) prizes are available.  The prizes are two (2) Optim Hand Vacuums with a total recommended retail price of NZ$79 per prize (each Optim Hand Vacuum is defined as a “Prize”).  

Godfreys will contact each Winner within two (2) business days of the Draw Date to arrange the most effective method to provide each Winner with a Prize.

A Prize may not be transferred or exchanged.

In the event a Prize is not collected by a Winner within 60 days of that Winner being notified of their entitlement to a Prize, that Prize will be forfeited and Godfreys will award the Prize to the Reserve Winner (see below). 

If the Prize (or any part thereof) is unavailable, Godfreys in its discretion, reserves the right to substitute the Prize (or that part thereof) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.

Godfreys will draw the Giveaway on the Draw Date.  The first two (2) valid Entries drawn will win a Prize (“Winning Entries”).  After each Entry has been drawn, that Entry will be removed from the draw.  An Eligible Participant is not eligible to win more than one (1) Prize even if the Eligible Participant has multiple Entries in the Giveaway.

The two (2) Eligible Participants to whom the Winning Entries belong are each winners of the Giveaway (“Winner”).  Godfreys may draw additional reserve Entries and record them in order in case an invalid Entry is drawn (“Reserve Winner”).  Each Winner will be notified in writing via:

·        direct message on Instagram; and

·        announcement posted on the Giveaway Post.

Godfreys’ decision is final and no correspondence will be entered into.

All Eligible Participants consent to: (a) participate in reasonable promotional activities, including but not limited to interviews and photographic and recording sessions, in respect to their participation in the Giveaway (including any outcome); and (b) Godfreys using their name, likeness, image and/or voice in the event they are a Winner (including photograph, film and/or recording) in any media for an unlimited period without remuneration for the purpose of promoting this Giveaway (including any outcome), and promoting any products manufactured, distributed and/or supplied by Godfreys or their related entities.

If the Giveaway is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the control of Godfreys, including but not limited to technical difficulties, unauthorised intervention or fraud, or force majeure, Godfreys reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any Eligible Participants or Entries; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the Giveaway, as appropriate.

Nothing in these terms limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Consumers Guarantees Act, as well as any other consumer protection laws in New Zealand (“Non-Excludable Guarantees”).  Except for any liability that cannot be excluded by law, including the Non-Excludable Guarantees, Godfreys (including its respective officers, employees and agents and related entities) excludes all liability (including negligence) and will not be liable for: (a) any personal injury; (b) any loss or damage (including loss of opportunity) including direct, indirect or consequential loss (c) third party interference; (d) late, lost, altered, damaged or misdirected Entries; (e) variation in the Prize; (f) any tax liability incurred by a Winner or Eligible Participants; (g) use of / taking of the Prize; or (h) technical malfunction impacting the operation of the Giveaway, arising in any way out of the Giveaway.

As a condition of accepting the Prize, a Winner must sign any legal documentation as and in the form required by Godfreys and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form. 

By entering the Giveaway, each Eligible Participant consents to the collection of their personal information by Godfreys.  Personal information collected will be used to facilitate the administration of this Giveaway, marketing of the Giveaway and Godfreys, and to allow Godfreys to communicate with Eligible Participants. 

Godfreys may disclose personal information to third parties for the above listed purposes.  Godfreys will collect and store personal information in accordance with the terms of their respective privacy policies, copies of which can be accessed at https://www.godfreys.co.nz/privacy-policy.  Each Winner consents to the publication of their name and suburb of residence as required by law.
